At My School Music, we are committed to protecting the privacy and security of your personal information. This Privacy Statement outlines how we collect, use, disclose, and store your personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).
1. Data Collection
My School Music collects Your Data by means that are fair, legal, and transparent.
The My School Music administration system collects personal information about students on behalf of the school music program registered with My School Music. In this capacity, My School Music acts as an agent in collecting student information for the School Music Program and produces various reports and notifications for the School. The Personal Information we collect on the site may include: first name, last name, parent/guardian name, email address, mailing address, birth date, class, instrument(s), ensemble(s), medical information (e.g., allergies, doctor name, etc.), and any other information the school music program may choose to collect.
All interactions on the My School Music administration system are logged to a log file. Information logged includes: date and time, administrator’s login name, IP address, action performed, and the record affected by this action.
2. Data Security
My School Music takes reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These steps include:
- Storing your personal information in a MySQL version 8 database, which supports industry-standard security measures.
- Hosting the database server with The Constant Company, LLC in their Australian-based data centre. This ensures that the primary storage of your personal information remains within Australia.
- All My School Music servers are placed behind a firewall, which helps to prevent unauthorised access to our systems and data.
- Utilizing industry-standard Secure Sockets Layer (SSL) technology to transmit your information through an encrypted channel between your internet browser and our server for both the administration system and the student registration site.
- Protecting Personal Information through passwords chosen by school administrators. Administrators are responsible for selecting non-obvious passwords (not names, addresses, etc.) and changing them periodically.
- Implementing security policies and procedures, including access controls and staff training on privacy obligations.
- Regularly reviewing and updating our security measures to address new threats and vulnerabilities.
- Storing uploaded images and files in a replicated cloud data storage. Please be aware that while we strive to choose reputable providers with strong security measures, this content may be stored on servers located outside of Australia.
While we strive to protect your personal information, no method of transmission over the internet or electronic storage is completely secure.
3. Data Use
Use refers to the application of Your Data by My School Music, or any staff member or contractor of My School Music in the course of their work.
My School Music undertakes to use Your Data only for the following purposes:
- Providing and Managing the Service: To create and manage user accounts and provide access to the My School Music platform and its features.
- Facilitating Educational Activities: To enable schools and educators to manage student musical education, track progress, organise music programs, and communicate relevant information. As an agent, we use student information as directed by the school music program.
- System Monitoring and Improvement: To log system usage for security, auditing, and to help us understand how the platform is used so we can improve its functionality and user experience.
- Communication: To communicate with school administrators regarding their accounts, system updates, support inquiries, and other relevant information about My School Music.
- Legal Compliance: To comply with our legal obligations, including those under the Privacy Act.
- Such other purposes as are subsequently agreed between My School Music and You.
- Such additional purposes as may be required by law. In these circumstances, My School Music will take any reasonable steps available to it to communicate to You that the use has occurred, unless it is precluded from doing so by law.
4. Data Disclosure
We may disclose your personal information to the following:
- School Administrators and Teachers: For the purpose of managing and delivering music education within your school. As My School Music primarily serves schools, this is a necessary part of the service.
- Third-Party Service Providers: We may engage third-party providers to assist us with services such as hosting, data analytics, customer support, and email communication. These providers are contractually obligated to protect your personal information in accordance with the APPs.
- Legal Authorities: If required by law, or in response to a valid legal request, we may disclose personal information to law enforcement agencies, regulatory bodies, or other government authorities.
- In case of a Business Transfer: In the event of a merger, acquisition, or sale of all or a portion of our assets, your personal information may be transferred to the acquiring entity, subject to the terms of this Privacy Statement.
5. Data Retention and Destruction
Subject to the qualifications below, My School Music undertakes:
- To retain Your Data only for as long as your school maintains an active account with My School Music.
- To take reasonable steps to destroy or de-identify Your Data within a reasonable timeframe after the termination of your school's account with My School Music, in a manner that ensures it cannot be subsequently recovered.
This undertaking is qualified as follows:
- Your Data may be retained in My School Music's logs, backups, and audit trails within short-term retention cycles that are devised to protect the company's operations and ensure system stability. In such cases, Your Data will be destroyed in accordance with those cycles.
- Your Data may be retained beyond the expiry of its primary purpose if authorised or required by law (in particular, to protect My School Music's legitimate interests, e.g., in the event of a dispute or suspected unlawful activity). In these circumstances, My School Music will only retain Your Data for the duration necessary to address the specific situation and will then take reasonable steps to securely destroy or de-identify it.
6. Access to and Correction of Personal Information
You have the right to request access to the personal information we hold about you and to request corrections if you believe it is inaccurate, incomplete, or out-of-date. To make a request, please contact your school's administration in the first instance, as they are the primary controllers of student data within the My School Music system. School administrators can then use the platform's tools or contact us for assistance. We will respond to valid requests within a reasonable timeframe, usually within 30 days. We may need to verify your identity before providing access to or correcting personal information.
7. Changes to These Privacy Undertakings
My School Music reserves the right to modify or amend this Privacy Policy at any time and for any reason. If there are material changes to this policy, My School Music will post a prominent notice on the My School Music administration system prior to implementing the change. The amended Terms shall automatically become effective immediately after they are posted. Your continued use of the site after the posting of the amended Terms on the Site constitutes your affirmative: (a) acknowledgement of the terms and its modifications; and (b) agreement to abide and be bound by the terms, as amended.
